With the exception of the documentation fee and some outside
services, the fees below are included in the rate or fee structure
of executed leases, loans, and financial services hereinafter
referred to as leases. However, these rates and charges are fully
applicable in the case of termination, cancellation, or unilateral
amendment of the lease and/or lease application by the lessee,
including the failure to produce reasonably requested financial
information and/or failure to take delivery and acceptance of the
equipment prior to the approval expiration. The applicant's
signature on the "PROPOSAL", "FEE POLICY", "LEASE APPLICATION",
"CLIENT CREDIT INFORMATION", "NON-COMMITMENT LETTER", "TERMS
AGREEMENT", or lease or loan documentation constitutes
acknowledgment and acceptance of the fees and charges below. In the
case of there being a formal written approval and/or executed lease
documents and then cancellation or unilateral amendment of the lease
by the Lessee/Applicant, ABEL would be entitled to the greater of
the above fee calculation or the full expected gross profit or fees
had the lessee/applicant performed as agreed plus legal and other
costs of collection of the amount due. Attempted fraud or
